SOTOMAYOR SCREWS UP BIG TIME

This morning on Steve Kornacki’s, show UP on MSNBC, one of his guests made a great point about the Justice Sotomayor ruling about the power employers have over employees—she issued a stay order. The ruling had to do with the right of Catholic nuns to be exempt from paying for birth control. Under the Affordable Care Act (ACA) most health insurance plans are required to cover FDA approved contraceptives. Logically, it is part of the women’s preventive care.  Churches and houses of worship are exempt from the birth control requirement. The problem arises from the expression “some religions affiliated organization” including charitable organizations, universities, and hospitals.  Do these organizations have the right to “mandate” the type of insurance plans the employees have?  The law says that institutions that serve the general public are not exempt.

The Sotomayor stay order is feeding red meat to conservatives that do not want people to have affordable health care. It open up the tired old argument used by people like Rand Paul, “if you own it you control it”. Remember the lunch counter statements where Senator Paul famously declared the lunch counter owner could serve who he wants—black, white, or whoever.  It gave rise to a flood of conservative rhetoric of hate; Obama is forcing the Little Sisters of the poor to buy contraception. They will bombard the courts with case after case trying to exempt employees of every religious affiliated organization from the Affordable Care Act. I was thinking that the conservative argument as being so weak that it is ludicrous, like Larry the Cable Guy, the comedian, might look it then I realized that he probably has the same basic beliefs as Phil Robertson and would probably believe it. They do this knowing that they will lose but it provides them with a bully pulpit provided by the radical media: Glenn Beck, Rush Limbaugh, etc. The tragedy is that the Duck Dynastic types, including some congressional representatives, believe this because that is all they listen to therefore that is all they know. Associate Justice Sonia Sotomayor screws up big time. Clever people like Karl Rove will use her stay order to influence weak-minded Republicans and that is not funny.
